Please read these terms and conditions carefully before using Our Service.

Welcome to the Nettakallappa Aquatic Centre website. These Terms and Conditions (“Terms”) govern your use of the website and constitute the entire agreement between you and the KN Guruswamy Educational and Charitable Trust (“the Trust”). By accessing or using the website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Service.

Definitions

The following definitions apply to these Terms:

  • Affiliate: An entity that controls, is controlled by, or is under common control with the Trust, where “control” means ownership of 50% or more of the shares, equity interest, or voting securities.
  • Country: Refers to Karnataka, India.
  • Device: Any electronic device that can access the Service, such as a computer, mobile phone, or digital tablet.
  • Service: Refers to the Website.
  • Terms and Conditions (or “Terms”): These Terms and Conditions, which form the entire agreement between you and the Trust.
  • Trust (or “We,” “Us,” or “Our”): Refers to KN Guruswamy Educational and Charitable Trust, located at 47/1/40, Uttarahalli Main Road, Padmanabhanagar, Bengaluru-61.
  • Third-party Social Media Service: Any services or content provided by a third party that may be displayed or made available through the Service.
  • Website: Refers to the Nettakallappa Aquatic Centre website, accessible from https://nac.org.in/.

You (or “Your”): Refers to the individual accessing or using the Service, or the company or legal entity on behalf of which such individual is accessing or using the Service

Acknowledgment and Eligibility

Your use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all users, visitors, and others who access the Service. By using the Service, you confirm that you are over the age of 18. The Trust does not permit individuals under 18 to use the Service.

Your access is also conditioned on your acceptance of and compliance with our Privacy Policy, which outlines how we collect, use, and disclose your personal information. Please review our Privacy Policy carefully before using the Service.

General Member Policies

  • Fees: All paid fees are non-transferable and non-refundable.
  • Media Consent: By giving media consent, you grant us the authority to use pictures and media of the member for various online platforms and social media.
  • Batch and Class Transfers: There are no batch transfers or extensions.
  • Assumption of Risk: All swimmers participate at their own risk. The Nettakallappa Aquatic Centre (NAC) is not responsible for any incidents, injuries, or loss of life. While precautions are taken and lifeguards are stationed, all members “swim at their own risk.”
  • Official Communication: For all official communication, please send an email to info@nac.org.in.
  • Assisted Learning: The Austswim teaching protocol may require physical contact. This physical contact is considered an aid to learning and should not be regarded as sexual harassment. By agreeing to these Terms, you endorse that assisted teaching may require physical help and touch.

Child Safeguarding Policy

NAC adheres to all standard measures and protocols mandated by the State of Karnataka under the POCSO Act to ensure the safety of its students. The academy expects all adults (parents and coaches) to understand and adhere to the following behavior expectations to ensure children’s safety.

Expectations for Parents

Parents of enrolled children are expected to:

  1. Meet Child’s Needs: Ensure the child’s physical health and nutritional needs are met appropriately. Do not push children to starve or over-consume to boost performance.
  2. Support Social-Emotional Well-being: Fulfill the child’s social and emotional needs. They should not be expected to isolate themselves from friends or social events. Regularly check in with your child about their social and emotional well-being.
  3. Promote Healthy Competition: Encourage children to compete without harsh or unfair judgment. Provide feedback without harsh comments, and remember that it is okay for their performance to dip. The goal is for them to feel safe and invested in learning the sport.
  4. Partner with Coaches: Collaborate with our coaches to help your child learn and enjoy swimming. Cooperate with feedback and recommendations, and express concerns openly. You and the coaches should act as a trusted team for the child.
  5. Maintain Routine: Help your child maintain a routine and discipline that helps them be present and attentive in classes. Do this collaboratively and do not enforce rigid rules. Listen to their concerns and seek help from coaches to address them.

Discouraged Parent Behaviors

Parents are strongly discouraged from the following:

  • Using harsh or abusive language toward your own or other children.
  • Threatening or physically assaulting a child.
  • Pushing the child or their coach toward excessive and intense practice sessions for performance gains.
  • Engaging in arguments or unfriendly behavior with other parents or caretakers.
  • Making open comparisons between children or their performance.
  • Normalizing jokes, sarcasm, or any form of humor about a child’s personality, body type, or general appearance.
  • Using labels or unfriendly gestures toward any child in the academy.

NAC is committed to ensuring children’s safety first and performance second. We will take action against physical, emotional, and sexual abuse, as well as neglect, if it is brought to our attention, as mandated by state law. By acknowledging these points, you agree to cooperate and adhere to these guidelines.

Our Service may contain links to third-party websites or services that are not owned or controlled by the Trust. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that the Trust is not responsible for any damage or loss caused by your use of or reliance on any such third-party content, goods, or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites you visit.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

Limitation of Liability

To the maximum extent permitted by applicable law, the total liability of the Trust and its suppliers under any provision of these Terms will be limited to the amount you have paid through the Service or $100 USD if you have not made any purchases.

The Trust and its suppliers will not be liable for any special, incidental, indirect, or consequential damages (including, but not limited to, damages for loss of profits, data, or personal injury) arising from the use of or inability to use the Service, even if advised of the possibility of such damages.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided “AS IS” and “AS AVAILABLE” and with all faults and defects without any warranty. The Trust disclaims all warranties, whether express, implied, statutory, or otherwise, including all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

The Trust does not warrant that the Service will meet your requirements, achieve any intended results, operate without interruption, meet performance or reliability standards, or be error-free.

Governing Law

These Terms are governed by the laws of the Country (Karnataka, India), without regard to its conflict of law rules. Your use of the Service may also be subject to other local, state, national, or international laws.

Dispute Resolution

If you have any concern or dispute about the Service, you agree to first try to resolve the dispute informally by contacting the Trust at info@nac.org.in.

  • For European Union (EU) Users: If you are an EU consumer, you will benefit from any mandatory provisions of the law of the country in which you reside.
  • United States Legal Compliance: You represent and warrant that you are not located in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country, and you are not on any U.S. government list of prohibited or restricted parties.

Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, it will be modified to the greatest extent possible under applicable law, and the remaining provisions will remain in full effect. The failure to exercise a right or to require performance of an obligation under these Terms will not affect a party’s ability to exercise that right or require that performance later, nor will a waiver of a breach constitute a waiver of any subsequent breach.

Changes to These Terms and Conditions

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is significant (“material”), we will provide at least 30 days’ notice before the new terms take effect. By continuing to use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the website and the Service.
